Trump Celebrates the Chance to Replace Justice Ginsburg & Destroy the Affordable Care Act

Donald Trump celebrated his opportunity to replace Supreme Court icon Ruth Bader Ginsburg with a conservative woman justice while speaking at a rally in an airplane hanger in Fayetteville, NC yesterday. It was a raucous crowd that clearly wanted the President to quickly nominate a new justice, breaking into chants of “FILL THAT SEAT,” after Trump mentioned Ginsburg's passing. The President's base seems to understand what is at stake with the appointment of a sixth conservative justice. And, Senator Chuck Schumer, the Democratic leader in the Senate, spelled it out for progressives in a call to his colleagues.

Schumer, New York Times: “Health care, protections for pre-existing conditions, women’s rights, gay rights, workers’ rights, labor rights, voting rights, civil rights, climate change and so much else is at risk.”

In other words, replacing RBG with a conservative like Amy Coney Barrett or Barbara Lagoa will have a very real and lasting impact on the nation, starting with the Affordable Care Act, protections for those with pre-existing conditions, and medicaid expansion. The Supreme Court is about to take up the case of Texas v US which will determine Obamacare's fate and the Trump administration has supported efforts to gut the law.

Kaiser Family Foundation: "The Affordable Care Act’s (ACA) future continues to be uncertain as the law’s constitutionality will once again be considered by the U.S. Supreme Court in California v. Texas (known as Texas v. U.S. in the lower courts). Oral argument is scheduled for Tuesday, November 10, 2020."
New York Times: "Arguments in a seminal case that could determine the future of the health care law are set for a week after Election Day, with the administration supporting a Republican effort to overturn it. Mr. Biden will accuse the president, as he already has, of trying to eliminate protections for pre-existing conditions during a pandemic, aides said, with the stakes heightened by a Supreme Court now short one of the liberal justices who had previously voted to keep the law in place."

Despite the precedent he set with Merrick Garland in 2016, Senate majority leader Mitch McConnell, lacking a gene for shame, will move forward quickly to get another conservative on the Supreme Court to hear Texas v US. And, there may be no way to stop him.

So, the upcoming election [both for the presidency and congress] has become even more pivotal to America's future and what kind of nation we will be. Those two branches of government, working in concert, can forge a progressive agenda that the court can't obstruct.
